Let me lay the groundwork for what I am about to post. I'm going to post two REAL chat room conversations I had with Bank of America. The first one was in November when they wouldn't let my daughter shut her account, and the second chat was today Jan 2, and was about them STEALING $75.29 from my son's unrelated account and paying off my daughter's negative account which she doesn't use anymore and they wouldn't let us shut down in November. My daughter Deanna's account was overdrawn on Sep 30 by $5.29 (YES, five bucks). She got TWO $35 overdrawn fees (due to them sorting them to their advantage, they could've paid the smaller one and only bounced the larger one. But they first bounced the larger one, so the smaller one would also bounce. They reversed ONE of these after arguing that point with them.), and a $35 "extended negative balance fee" (how do you like THAT one!!!) - that's $105 dollars in fines for going over FIVE BUCKS (now $70 in "fees" because they reversed ONE of them. Keep in mind, they didn't just reverse the ONE out of the goodness of their heart, it was after even an earlier, vicious, time-consuming argument with them.). The first chat will be of us trying to close Deanna's account in November, and they won't let us close the account. The second chat with Bank of America will be of us detecting that they UNAUTHORIZED took $75.29 from my son's account to pay my daughter's -$75.29 balance from her account she hasn't used in months, doesn't want, and Bank of America wouldn't let us close.
Note: I changed some minor things such as social security numbers or other sensitive things like that, but 99% of the chat transcripts are original.
Some notes if you care:
- I changed some of the account, social security numbers, & telephone numbers, but these 2 Bank of America "chats" are 99% cut/paste from the actual "chats".
Also, note the "chat" person's CANNED ANSWERS repeated over and over, such as:
- I UNDERSTAND HOW YOU FEEL (or frankly, any sentence with "UNDERSTAND" in it)
- THANK YOU FOR BEING A VALUED CUSTOMER (LOL!!!!!!!!!!!!!!!)
- I APPRECIATE YOUR PATIENCE (or anything with "PATIENCE" in it)
- "COURTESY"
- "HUMBLY"
- "PLEASE"
- "MAY I?"
- "I TRULY APOLOGIZE" (but we're screwing you anyway!)
- "INCONVENIENCE"
- "I WILL DO MY BEST"
- "I DO NOT WANT YOU TO FEEL ANY UNSATISFACTORY EXPERIENCE" (what? WHO talks like that? I mean besides sex call lines)
- "I RESPECT YOUR OPINION"
- "WE CARE AND LISTEN TO OUR CUSTOMERS" --->>> BOA thinks "SAYING" something makes it REALITY
- "I'M SORRY" (keep in mind, as they say things like "I'M SORRY", they're not listening to anything you're complaining about, doing anything about it, etc...they're just saying "WE CARE AND LISTEN TO OUR CUSTOMERS" while totally disregarding what you're saying and requesting)
- "THANK YOU VERY MUCH"
- "I CERTAINLY UNDERSTAND YOUR POINT"
(here's my favorite one, ready?)
- "SENIOR CHAT SPECIALIST" --->>> LOL!!!!!!!!!!! "we're going to connect you with a 'SENIOR CHAT SPECIALIST' who won't care at all what you're saying, but will PRETEND to to care with canned answers like 'I RESPECT YOUR OPINION', which will be said word for word several times by this 'SENIOR CHAT SPECIALIST' and any other ones we connect you with...that is, if they even exist and aren't computers". SENIOR CHAT SPECIALIST: these people DO NOT EXIST, FOLKS! Do you personally know anyone who's a SENIOR CHAT SPECIALIST? It's like "THE DEFENSE BUDGET", "AL QAEDA", "INSURGENTS", "THE TERRORISTS", "DEATH PANELS", "AUSTERITY", etc...etc...
Let me make up a sentence from the above:
"I'm a senior chat specialist, I understand how you feel about these charges, I do not want you to feel any unsatisfactory experience, I appreciate your patience, but I humbly, courteously, please apologize for NOT GIVING YOU YOUR $70 BACK THAT WE STOLE OFF YOU!!! I hope that me telling you this, has not given you an unsatisfactory experience. Was that unsatisfactory for you? I know it was for me! I want you to know that you are a valued customer. I respect your opinion. YOU ARE AN IDIOT if you believe a word I'm saying." -> this is actually very sad, that we live in times like this.
Do you think ANY of these people I "chatted" with were in the United States of America or their American-sounding names are really their names? I don't think so! That's why they have cut/paste answers like: "I DO NOT WANT YOU TO FEEL ANY UNSATISFACTORY EXPERIENCE".
Notice all this "POLITENESS" leads to us GETTING SCREWED BY BANK OF AMERICA anyway!!! But they were "POLITE" about STEALING $70 off of us!!! So it's: "OK".
I also highlighted some key sentences in the first chat in red and blue. The second chat came out in color, I wish the first one in November did.
CHAT #1 November 11, 2011
We try and close my daughter's account and get $70 fees reversed on a negative $5.29 balance ($-75.29 balance; $70 of it "fees", $35 for being $5.29 overdrawn, and $35 "extended negative balance fee"...keep in mind, they won't let us close her account, and the "extended negative balance fee" could go on indefinitely, because they won't let us close the account)

Thank you for choosing Bank of America. You are now being connected to a Bank of America Online Banking Specialist.
Claudia: Hello, my name is Claudia. Thank you for being a valued customer of Bank of America. I'm here to assist you with your personal accounts today. May I please have your complete name as it appears on your account and the last four digits of your account number to further assist you?
You: deanna , 5555, 888888888888
Claudia: A warm welcome to online chat, Deanna!
Claudia: Thank you for the information provided.
Claudia: How may I assist you today?
You: this account was at -5.29. please reverse the "FEES" bringing it back to -5.29, close the account, and send a bill for $5.29
Claudia: I understand that you would like to bring the account balance to $0.00 and close the account.
You: right
Claudia: I will certainly check that for you.
Claudia: Please give me a couple of minutes while I access your account.
Claudia: Thank you for your patience.
Claudia: I see that you have negative balance in your account.
You: I'm requesting the reversal of two $35 "FEES", bringing it back to the original -5.29, then I will pay $5.29 and close the account.
Claudia: Let me check what best I can do for you.
Claudia: I appreciate your patience.
Claudia: I see that we have previously spoken with you about these fees. I am unable to refund these fees in question.
You: OK, first of all, banks just had a class action lawsuit against them for sorting transactions to maximize "FEES", which you did in this case.
You: second: the transactions should've been rejected due to not enough in the account
You: third: this fabricated "EXTENDED NEGATIVE BALANCE FEE" is RIDICULOUS!
You: immediately shut down this account
Claudia: Although we are not obligated to pay an item presented if your account does not have sufficient funds, we may pay it as a courtesy. An overdraft fee or a returned item fee (NSF) will be assessed whether the item is paid or returned.
You: I didn't want that "courtesy", the "FEE" was greater than the "courtesy", does that make any sense? why would I want you to pay $5.28 transaction as a "courtesy", only to get a $35 "FEE"???
You: does that make sense to you?
You: you're not addressing my request: please shut down this account. are you going to shut down this account?
Claudia: I absolutely understand your concern, Deanna
You: are you going to shut down this account?
Claudia: Once the account balance is $0.00, I would be able to submit your request to close the account.
You: 1. reverse the $70 "FEES"
You: 2. shut down this account
You: I am not paying the $70 "FEES", they are fabricated "FEES" by BOA
Claudia: I wish I could have some some help to you. The account at this point in time fails to qualify for a refund.
You: ARE YOU SHUTTING DOWN THIS ACCOUNT???
You: YES OR NO?
You: why can't I get an answer to that question?
Claudia: Deanna, Once the account balance is $0.00, I would be able to submit your request to close the account.
Claudia: Deanna, do you see any unauthorized transactions?
You: so, you are NOT shutting down my account, even though I am telling you to shut my account?
Claudia: I wish I could, however I'm unable to close your account with negative balance.
Claudia: We do have a dedicated department who will take care of this issue for you. Let me get the contact information of them.
Claudia: May I?
You: SO...you will not shut down this account, and it will keep getting "EXTENDED NEGATIVE BALANCE" fees?
You: is that correct? BOA refuses to shut down my account, so they can keep making $35 "EXTENDED NEGATIVE BALANCE" fees?
Claudia: For each time we determine your account is overdrawn by any amount and continues to be overdrawn for five or more consecutive business days, we will charge an Extended Overdrawn Balance Charge of $35.00.
Claudia: This fee is in addition to applicable Overdraft Item Fees and NSF: Returned Item Fees.
You: also, you ADMIT you paid 2 transactions as a courtesy I DID NOT WANT, causing $70 in "FEES", then added another $35 "EXTENDED NEGATIVE BALANCE" fee. That is all FABRICATED "FEES"! by BOA
Claudia: Please do not make any transactions so that transactions will not be debited from your account.
You: There are 3 unjust "FEES" here. I did not want you to pay two items which were less than the "FEE", that's ridiculous, that's not a "courtesy". And then this extended negative balance fee will go on forever.
You: well, what about the "EXTENDED NEGATIVE BALANCE" fee?
You: I'm notifying you that I hereby want this account shut and owe you $5.29.
Claudia: I humbly request you to contact us at 1800.432.1000 to resolve this issue. We are available from 7:00 a.m. to 10 p.m. Monday through Friday, 8 a.m. to 5 p.m. Saturday and Sunday, Local time.
You: I'm not responsible for anything else, or anything else going forward. I'm keeping this chat in case we go to court.
You: THIS is the contact: I want this account shut down, and I only owe BOA $5.29.
You: please forward this chat to your supervisors.
CHAT #2 January 1, 2012
We notice $75.29 taken from my son's Bank of America account WITHOUT CONSENT OR AUTHORIZATION transferred to pay my daughter's -$75.29 Bank of America account, which she doesn't use anymore and they won't let her close down. Bank of America ADMITS my son's account and daughter's account are UNRELATED, but they took $75.29 from my son's account to pay my daughter's negative account, anyway.
If I were to TITLE this 2nd chat, the title would be:
"You: Do you think $70 is excessive on $5 overdrawn? Abegail : No."

Katrina: Hello! My name is Katrina. Thank you for being a valued Bank of America customer!
Katrina: To begin with may I have your full name as it appears on our records and the last four digit of your account number concerned please?
You: You illegally transferred $75.29 from one account to another:
You: 12/30/2011 TRANSFER FROM RELATED ACCOUNT 000009999999999 $75.29 $0.00
You: without our consent
You: you transferred $75.29 from Deanna account to David account WITHOUT CONSENT!!!
You: THEY ARE NOT "RELATED ACCOUNTS"
Katrina: My sincere apologies for the inconvenience.
Katrina: I do understand how you feel about the unuathorized transfer on your account.
Katrina: For verification, may I have your full name as it appears on our records and the last four digit of your account number concerned please?
You: BOA did that, not the account holders, and those accounts are NOT RELATED
You: Dan
You: and don't give me some bullshit story that they are "related", please!
Katrina: Thank You Dan. May I verify as well the last four digit of your primary account number?
You: 7777
Katrina: Thank You.
Katrina: Let me go ahead and pull up your account so I can review what happened with the transfer.
You: you UNAUTHORIZED took $75.29 from David account and put it into Deanna account
You: Now, when the Deanna account had NEGATIVE BALANCE, why didn't you do the OPPOSITE and take from David account to put into Deanna account SO THERE WERE NO OVERDRAFTS???
You: I notice this "thievery" only works to Bank of America's advantage
Katrina: Dan, I can understand how you feel right now, if I would have been in your place I certainly would feel the same way as you do.
You: so when you gave Deanna account ALL THOSE PENALTY FEES, I notice you didn't take from David account to PREVENT those fees!
Katrina: Please allow me a few moment to review your account and see how we can resolve this issue today.
You: David account is going to FLIP OUT when he finds you just TOOK $75.29 from his account for another account!!!
You: without authorization on an UNRELATED account!
Katrina: Dan, I believe you have provided me your SSN. May I again verify the last four of your primary checking account.
You: 3333
You: 7777
Katrina: I apologize but I am unable to pull up an account ending in 3333 either. If you wish I will be happy to provide you the steps how to view your account number online.
You: 7777
You: I wrote it wrong
You: The point is: if the accounts are "related", and you can take money from one account to another, then at the time the Deanna account was "overdrawn" and got all those overdrawn charges, BOA should've "taken" money from the David account to PREVENT all those fees.
You: YOU CAN'T HAVE IT BOTH WAYS!
Katrina: Dan, I understand your point and in that case you need to worry since you can file a dispute on the wrong transfer that had happened with your account.
Katrina: I still was not able to pull up account ending in 7777.
You: In fact, you should REVERSE the two $35 "fees" on the Deanna account, giving the REAL negative balance of - $5.29, then take the $5.29 from the David account, and shut down the Deanna account, like we wanted in the first place
You: Why don't you just REVERSE the two $35 fees on the Deanna account, giving the TRUE negative balance of -$5.29, then take the $5.29 from David account, and then close out the Deanna account?
Katrina: To change the display options for your account number, please follow the steps below.
Katrina: - Select the Accounts tab
Katrina: - Select an account you wish to view
Katrina: - Select the Account Details sub-tab
Katrina: - Select the Show Account Number link that is located on the left hand side of the screen. This will show the full account number.
You: Because those two $35 fees on the Deanna account should not have occured. They should've taken $5.29 from David account back then, the same way you just took money from the David account NOW for the $75.29.
You: Deanna account = 008888888888
You: David account = 009999999999
Katrina: Thank You very much.
Katrina: Please give me a few moment while I pull up your account.
You: You took $75.29 from David account on 12/30 for the Deanna account
Katrina: Thank You for the additional information.
You: on 9/30, if you did the OPPOSITE and took only $5.29 from the David account and put it in the Deanna account, Deanna account would never have had all those fines!!!
You: You need to do this:
You: 1. Put the $75.29 back into the David account that you took to put into the Deanna account
You: 2. reverse the two $35 fines in the Deanna account, giving a balance of -$5.29
You: 3. move $5.29 into the Deanna account from the David account, and close the Deanna account
You: THAT IS WHAT YOU SHOULD'VE DONE IN THE FIRST PLACE BACK ON 9/30!!!
You: BOA is getting in big trouble for doing things like this to fabricate fines!!!
Katrina: Dan, I truly apologize for the inconvenience, as I checked your account on our record, I can see that the transfer made was due to overdrawn account.
You: do you understand a word I'm saying?
Katrina: Yes Dan, I do understand that the two accounts are not related and the transfer should not be made, right.
Katrina: And as I am reviewing your account I can see that there is already a refund made on the account on 12/01 for the amount of $35.00
You: OR...why don't you put the $75.29 BACK in the 4590 account (FROM the 2482 account), then reverse the two $35 fines in the 2482 account, giving the original -$5.29 balance, then take $5.29 from 4590 to 2482, and close the 2482 account...WHICH IS WHAT WE ORIGINALLY WANTED AS FAR BACK AS SEPTEMBER???
You: then it would be "case closed"
You: I called and argued this SAME THING a long time ago
Katrina: Okay Dan, I will do my best with the refund as I do not want you to feel any unsatisfactory experience with Bank of America. However for the transfer, please be advised that While we make every effort to assist our customers who contact us by Live Chat, there are certain situations which require a conversation with a Customer Service Specialist that can further assist you with your concern on the transfer that happened on the account.
You: great, I would LOVE to talk to someone on the phone, because this is a HUGE ILLEGAL RIPOFF
You: I have a popular internet site, and I could put this up on my internet site and youtube.
You: you should have a "specialist" call me at 123.456.7890
Katrina: Dan, I am still trying my best to help you with the refund. Please bear with me.
Katrina: And for your concern today on the transfer, I humbly request you to please contact us at 1.800.432.1000. We are available from 7 a.m. to 10 p.m. - Mon - Fri and from 8 a.m. to 5 p.m. - Sat - Sun, Local Time
You: are you doing what I suggest, which would be: put the $75.29 BACK in the 4590 account (FROM the 2482 account), then reverse the two $35 fines in the 2482 account, giving the original -$5.29 balance, then take $5.29 from 4590 to 2482, and close the 2482 account...WHICH IS WHAT WE ORIGINALLY WANTED AS FAR BACK AS SEPTEMBER???
You: why can't someone call me right NOW? I just gave you my phone number!
You: In fact, I could be on the chat AND on the phone at the same time.
Katrina: Dan, if only I can transfer the money to the original account via this channel, I would have done that right away.
Katrina: And for your request to call you at your phone number, please be advised that we need to schedule a call back first and you can provide me today the best time to call you to immediately resolve this issue with your account.
Katrina: I hope you understand.
You: right now, any time, call me
Katrina: I understand Dan, that you can be contacted right now, but we still need to schedule the call back for you. And rest assured that our associates will call you with the schedule you can provide other than today.
You: This could end very quickly and happily, if you JUST: put the $75.29 BACK in the 4590 account (FROM the 2482 account), then reverse the two $35 fines in the 2482 account, giving the original -$5.29 balance in the 2482 account, then take $5.29 from 4590 to 2482, and close the 2482 account
You: This is exactly why thousands of people, including ME, are leaving BOA. If, back when I first suggested this, BOA listened to me, I'd still be a customer there. As it is, I shut down my 003830178109 account, and am in the process of shutting down ALL these accounts and going to a credit union.
You: People get these RIDICULOUS fines, BOA could easily listen to what customers are telling them, and they'd still have those customers. But they don't listen to a darn thing customers say, give them fines, and basically say, "too bad".
Katrina: Thank you for your patience, I will be right with you.
Katrina: Dan, as I am checking further on you account. I can see that the last overdraft fee of $35.00 that was charged on the account ending in 2482 was last 10/07.
You: the REAL balance on 2482 is negative $5.29, the rest are "fees"
You: back in Sep/Oct, BOA should've taken $5.29 from 4590 for 2482, and all those fees should not have occurred. that is why I am closing my BOA accounts.
You: instead of listening to REASON back then, BOA did not care what I had to say.
You: that is why people are leaving BOA in droves, does BOA care? apparently they don't
You: I'd like to know why, back in Sep/Oct, the accounts were "UNRELATED", when it was to OUR benefit...and now they are suddenly "RELATED" when it comes to BOA's benefit!!!
Katrina: Thank you for waiting. I'll be with you in just a moment.
You: that reeks of underhandedness
You: And I'm telling you, I have a very popular internet site where I report on things like this.
You: I have this whole conversation copied.
Katrina: I understand how you feel about the transfers that happened on your account.
You: I am a citizen journalist.
Katrina: I apologize for the delay. I'll be with you shortly.
Katrina: If you wish I can also place a note on your account regarding the issue with the transfer on your account.
You: well what exactly did you do?
Katrina: Dan, I have reviewed your account and here is what happened why the transfer comes out from your checking account ending in 4590.
You: It better involve putting $75.29 back in account 4590.
You: That person's RENT will bounce, if you don't.
Katrina: I can see that the account ending in 2482 was linked on your regular savings account ending in 2044 for Overdraft Protection Service. Wherein an automatic transfer will come out from your funding account which is the savings account ending in 2044 if the account was overdrawn.
You: I can tell this is going to be some answer where you're not going to put the money back in 4590, am I right?
You: Keep in mind, I wanted 2482 shut down, and BOA would not shut it down.
Katrina: Dan, as much as I would like to help you make the transfer for you the $75.29 that was made, I apologize but I am unable to do the transfer via this channel.
You: Account 4590 will BOUNCE RENT if you don't put that money back!
You: What is your explanation for freely moving money from 4590 to 2482 NOW, but not back in Sep/Oct???
Katrina: If only I can return back the money for you today Dan, I would have done that right away to help you prevent the check to bounce from your account.
Katrina: I can refer you to our Customer Service department for further assistance on that regard.
You: Not back in Sep/Oct, when they could've moved $5.29 from 4590 to 2482 and saved $105.00 worth of fines on only $5.29 overdrawn?
You: Furthermore, I thought there was a new law that a transaction causing a negative balance could not be made without the positive consent of the customer.
You: I don't want to get the "runaround" of you referring me to Customer Service, I would like this resolved NOW.
You: You CANNOT take $75.29 from 4590 for 2482 WITHOUT CONSENT. What is your explanation for this?
You: on 12/30, you took WITHOUT CONSENT $75.29 from 4590 and put it in 2482!!!!!!!!!!
You: What is your explanation for this?
Katrina: Dan, we have dedicated department who handles this kind of concern and as much as I would like to help you today transferring back the money of $75.29 to the account ending in 4590, I do not have access via this channel.
Katrina: If there would have been a way to help you out I would have certainly done that for you because I can understand how you feel right now.
Katrina: I really wish I could be of your help.
You: Can you answer this question: what gave you the authority to move $75.29 from 4590 to 2482 WITHOUT CONSENT?
You: Can you answer that question?
You: I'm not asking for HELP, I would like to to ANSWER A QUESTION. Can you do that? Simply answer that question?
You: So YOU are not Customer Service, and only Customer Service can help me? Is that what you are saying?
You: Can you put someone on from Customer Service right now?
Katrina: I apologize for the delay. I'll be with you shortly.
You: I want to chat with someone who can HELP ME. Now.
You: You said you couldn't help me, after all this time!
Katrina: Okay Dan, I can transfer this chat session to our senior chat specialist for further assistance.
You: I want to chat with someone who can HELP ME. Now.
You: You said you couldn't help me, after all this time!
Katrina: Okay Dan, I can transfer this chat session to our senior chat specialist for further assistance.
Katrina: Please give me a moment while I transfer the chat.
You: DO IT!
You: Transfer me to someone who can actually help.
Katrina: Please give me a moment to transfer the chat.

Jana: Hello! Thank you for being a valued Bank of America customer! My name is Jana. May I know your full name and last four digits of your account number?
You: Dan 4590
You: I need to talk to a senior chat specialist.
Jana: Hi, a pleasant evening to you Dan!
Jana: I certainly understand that you wish to talk to our Senior specialist.
You: I was on an extremely long chat with Katrina, and I think I got cut off. Katrina was transferring me to a senior chat specialist
Jana: I am sorry about that.
Jana: I can read the chat transcript.
You: Can you see the transcript with Katrina?
Jana: Yes, I can see it Dan.
Jana: Please allow me sometime to read it completely and I will try my best to help you.
Jana: I apologize for the inconvenience if your chat was disconnected.
You: it's very long
Jana: Yes, I can see that.
You: the bottom line is: BOA just transferred $75.29 from acct 4590 to 2482 "transfer to overdrawn RELATED account"
You: So, on 9/30 thru 10/7, account 2482 was overdrawn by only $5.29.
You: So, if they're "RELATED", then on 9/30 - 10/7 time period, 4590 should've transferred $5.29 to "RELATED" account 2482, and 2482 should NOT have had all those fines.
You: So I would like BOA to reverse the $70 worth of fines in acct 2482, then transfer that $70 from 2482 to 4590, and shut down 2482, which is what I wanted in the first place months ago, and I argued about this at the time back then to no avail. That is why I proceeded to start shutting down all my BOA accounts and move them to credit unions.
Jana: I can understand your concern regarding the overdraft fees on your MyAccess Checking 2044.
Jana: I apologize for the typo error.
You: Which acct ends in 2044?
Jana: I meant to say MyAccess Checking 2482.
You: If the accounts are "RELATED", as the 12/30 transfer from 4590 to 2482 says, then a $5.29 transfer should've occurred from 4590 to 2482 on 9/30, preventing those two $35 fines.
Jana: Dan, you might be referring to the overdraft protection where this MyAccess Checking 2482 is linked to your savings account 2044. With overdraft protection, whenever your account is overdrawn, an overdraft protection transfer will happen.
You: 4590 and 2482 are "related", correct?
You: because when 2482 was -$75.29, BOA transferred $75.29 from 4590 to 2482.
Jana: Please allow me to clarify this transfer of $75.29 from your related account 4590.
You: BOA transaction in 4590 states: "transfer to overdrawn RELATED account 2482" of $75.29.
You: Now when 2482 was overdrawn by $5.29 on 9/30, therefore there should've been "transfer to overdrawn RELATED account 2482" of $5.29, and 2482 should NOT have gotten those two $35 fines, which I want reversed.
Jana: If your checking account is overdrawn and there is another checking account on your profile, bank will transfer funds automatically on the overdrawn checking account.
You: GREAT!!!!!!!!
You: Then on 9/30, 4590 should have transferred $5.29 to 2482!!! That's my point!
Jana: The overdraft fees on your MyAccess Checking 2482 is another issue.
Jana: Please allow me to explain that to you.
You: So will you reverse the two $35 fines in 2482?
Jana: Your account has been overdrawn by negative $0.01 on 09/29 for the paypal transaction.
You: Wow, one cent.
Jana: This MyAccess Checking 2482 has an overdraft protection service linked on your savings account 2044.
You: Just like right now?
Jana: The funds should have been transferred from the savings account 2044 where the overdraft protection is linked however there is no funds on your savings account at that time.
Jana: Due to which, the overdraft fee has been assessed.
Jana: I certainly understand your point Dan.
Jana: The overdraft fee will be assessed if you overdrawn your account regardless of the transaction amount.
You: Why wasn't $5.29 transferred from "RELATED" acct 4590? Like it was for the SAME SITUATION on 12/30?
Jana: The transferred happened on 12/30 is a different case.
You: Really?
You: How so?
Jana: Your account has been overdrawn since September.
You: And we asked to shut it down, and BOA would not shut it down.
Jana: In order for us not to refer this account to a collection agency, we will collect the overdrawn balance from your checking account.
Jana: I apologize for the inconvenience if your request was not processed.
You: The accounts are "RELATED", therefore you should've taken $5.29 from 4590 for 2482 on 9/30, they are EXACTLY THE SAME CASE.
You: You are making things up to benefit BOA, that is exactly why people are leaving BOA.
You: You "made up" a rule to transfer from 4590 to 2482...WHEN IT BENEFITS BOA, but not when it benefits the customer.
You: Don't try and dazzle me. It's the same exact case on 9/30 as 12/30.
You: You "made up" a rule to make it seem like it wasn't.
Jana: Should you wish me to transfer this chat right away to the senior chat specialist to properly explain the process to you Dan?
You: the acct 4590 will BOUNCE RENT if you do not put that money back into that account.
You: the last time you did this, I got hung out to dry
You: DIDN'T I ASK YOU AT THE BEGINNING OF THIS CHAT IS YOU WERE A SENIOR CHAT SPECIALIST???
Jana: I will make sure that this time you will be connected Dan.
You: YES, transfer me to a senior chat specialist.
You: right
Jana: Sure, no problem.
Jana: Please hold while I transfer this chat.
You: We did not give permission for the 12/30 transaction.
Jana: I certainly understand that.
Jana: I will be transferring you to a senior chat specialist who will assist you further. I have explained the reason for you contacting us today. He will be online with you in just a moment. Thank you for your patience.
You: Let me recap: you will make an UNAUTHORIZED transfer from 4590 to 2482 so you don't have to send 2482 to a collection agency, but you will NOT transfer a measly $5.29 from 4590 to 2482 to prevent $105 worth of fines.
You: You say 4590 are "RELATED" when BOA makes $$$ off the transaction, but 4590 are NOT "RELATED" when it is to save the customer $105 of fines.
You: Got it!!!!!!!!!
Please wait while I transfer the chat to Abegail who can best assist you today.
Thank you for choosing Bank of America. You are now being connected to a Chat Specialist. For security purposes, please remember to close your chat window when completed.
Abegail : Hello Dan.
Abegail : My name is Abegail and I am a Chat Manager.
Abegail : Please give me a minute or two to take a look at the previous chat.
You: The bottom line here is that I would like the $70 in fines in acct 2482 reversed, because I would like to put that $70 back into acct 4590. There was an unauthorized transfer of $75.29 from 4590 to 2482 stating they were "RELATED". Now, if BOA would like to think they are "RELATED", then on 9/30 BOA should've transferred $5.29 from 4590 to 2482 to prevent all those fines in 2482.
You: Also, acct 4590 will BOUNCE RENT due to the unauthorized $75.29 transfer on 12/30 from 4590 to 2482.
You: Another aspect of this, is that I thought transactions causing negative balances are not to be done without explicit consent of customers.
You: Isn't that a recent law?
Abegail : Dan, thank you for the recap.
Abegail : I understand the issue and hear where you are coming from.
You: Are you a senior chat analyst?
Abegail : I'm a manager.
You: good
You: All these quirky little "rules" benefit BOA and not the customer, and that's why people are leaving BOA, and that is why I myself have started shutting my BOA accts for this exact thing that is happening
Abegail : The transfer fro 4590 to 2482 did not happen because they are not linked hence, the OD fee was assessed.
You: Well then the 12/30 transaction which stated "TRANSFER TO OVERDRAWN RELATED ACCOUNT 2482" of $75.29 should not have occurred.
You: If they are not related.
You: Now don't "INVENT" some rule where THAT one is OK!!!
You: but the other one isn't!
You: This is exactly what I'm talking about!
Abegail : As for the $75.29 transferred from 4590 to 2482, this was legal.
You: Oh, really?
You: Why?
You: Where did I authorize BOA to do that?
You: You KNOW...this is exactly why people are leaving BOA in droves. You understand that, right? Because of what is happening exactly right now, what you are doing to me?
Abegail : It is within the purview of the bank to collectible funds and this was part of the disclosure when you opened the account with us.
You: You DO realize that.
You: Right?
You: Can you show me where it says this?
You: Do you know that these two accts are not known to each other?
You: it is David and Deanna
You: and I am Dan
You: And BOA can just take $75.29 from David acct and put it in Deanna acct? That's stealing!!!!!!
You: David cannot pay his rent, he is on unemployment and needs every penny.
You: do you think this is right, that BOA does an unforseen transfer like this, and David is not able to take this into account?
You: Where did BOA notify us of this in advance?
You: You think this is RIGHT doing this?
Abegail : I don't have access to David and Deanna's account.
You: I don't care WHAT the "rules" are you have "made up".
You: I would like the $75.29 put back in the 4590 account, and the $70 in fines in 2482 reversed, leaving a negative $5.29 balance in 2482, and then transfer $5.29 from 4590 to 2482 and close out 2482.
You: BOA does not understand the ILL WILL they have created in the United States with actions like this.
You: Taking $70 from people who can't afford it.
You: BOA got bailed out BILLIONS by taxpayers. Do you understand all the ILL WILL toward BOA, when you spout out ridiculous "rules" like you are?
Abegail : Thank you for waiting. I'll be with you in just a moment.
You: BOA is so out of touch with what customers think of them, this is a prime example. After getting bailed out BILLIONS of dollars, you take $70 off people who can't afford it.
You: BOA has totally lost touch with the average American customers.
You: How much is that worth to BOA, $70???
You: When my son David can't pay his rent from acct 4590, is that worth the publicity to BOA? I have a very popular internet site, and I will put this up on it.
You: Is that worth $70?
Abegail : The OD fee on 2482 was not caused by the $75.29 but several PayPal transactions.
Abegail : Dan, I'm unable to refund the fees since these are not due to bank error.
You: Look: it's pretty obvious that you are more worried about reversing $70 than all the bad will it will cause and make BOA look even worse than they already look.
You: You certainly are able to reverse the $70, that's baloney.
You: I will put up on the internet, that my son cannot pay his rent because of this, and that's the truth.
Abegail : I respect your opinion.
Abegail : But the issue here is that the fee was assessed correctly.
You: The "big bank" that got bailed out BILLIONS of taxpayer money, takes $70 fees and kid can't pay his rent.
You: THAT is the issue. You're attitude is the issue. BOA's attitude is the issue.
You: You DON'T respect my opinion, or you'd reverse the $70 OR put back the $75.29 in 4590.
Abegail : I have reviewed your account but I'm sorry that the fee will have to remain on the account
You: And there goes the great BOA again, cares about their customers (who are leaving in droves).
You: You still haven't shown me where you are authorized to make that 12/30 transaction.
You: Can you show me what gives you authority to do that transaction without consent?
You: Do BOA superiors tell them to fight their customers for every penny of fines?
You: At all costs, even them leaving by the millions?
You: So will you do this: shut down account 2482, or will you REFUSE to shut it down like you did before, so it can keep accruing penalties?
You: Do you still REFUSE to shut down acct 2482, like I asked months ago?
You: So it can keep going negative so you can keep STEALING money from 4590 to pay for the fines you generate?
Abegail : I can close 2482 since it shows a zero balance
You: Now that you've STOLEN $75.29 from 4590 to put in 2482, you can now close 2482, right?
You: Also shut down 000000002044 before you GENERATE some fines from that one for BOA, also.
You: Did you notify the acct holder 4590 that you took $75.29 without authorization and he may have things bounce?
Abegail : Please give me a minute or two to close both accounts?
You: How does BOA feel, making $70 in fines on an account overdrawn by $5.29?
right now.
Abegail : I apologize for the delay. I'll be with you shortly.
Abegail : Your account closure request for -2044 has been submitted. Please take note of the Service Request 1281-537026127 and Expected Resolution Date is 01/06/2012.
You: So did you close 2482 and 2044?
Abegail : Thank you for your patience, I will be right with you.
Abegail : Your account closure request for -20482 has been submitted. Please take note of the Service Request 1281-537026152 and Expected Resolution Date is 01/06/2012.
Abegail : No further action is required on your part to remove the account from your Online Banking list of accounts. Once the request is complete, the account will automatically drop from your Online Banking profile.
Abegail : Please be aware that the closing of your account will not be completed if any outstanding items post to the account. Please note that all outstanding or recurring transactions are your responsibility. You should contact any third party that you have authorized to initiate debits or credits to your account and instruct them to discontinue those transactions.
You: will there be more fines between now and 1/6???
You: And payment stolen from acct 4590 to cover them?
You: Can you prevent any transactions on accts 2482 & 2044, so there are no fines between now and 1/6???
Abegail : The fee that can potentially apply are transfer fees if you decide to transfer funds within the resolution date.
You: So you closed accts 2482 and 2044, correct?
Abegail : Yes I did.
Abegail : Apart from this, would there be anything else I can look up for you today?
You: And you can't guarantee me prevention of all transactions from now until 1/6, that would cause any fines?
Abegail : If there are automatic transfers set up, you need to stop them so the account closure goes through.
You: I would like to know if you understand why people hate BOA, case in point $70 in fines on $5.29 overdrawn. I would like to know if you think $70 is EXCESSIVE for $5.29 overdrawn. Do you think that's excessive?
You: The reason I'm telling you, is because I don't this BOA understands why so many people are leaving BOA. I'm telling you why. I really don't think BOA cares why, though.
You: BOA isn't listening to what customers are saying, about excessive fines. Their only recourse is to leave BOA. I really don't think BOA cares, though. But I wonder if THEY wonder why people are leaving them. Don't they care?
Abegail : I know how you feel about our overdraft policy.
You: But does BOA CARE? That is my question.
Abegail : Yes we care and we listen to our customers, case in point is the Debit Card Fee.
You: BOA does NOT care. The evidence is that they aren't doing anything to keep customers, such as stopping $70 fees on FIVE DOLLARS OVERDRAWN! That is unbelievably excessive. ANYONE would agree.
You: Do you think $70 is excessive on $5 overdrawn?
Abegail : No.
You: And the debit card fee: BOA stated that they would "make that up in some other way".
You: I am up on all of this.
You: So, they might've stopped the debit card fee, but why did they even try it, that's #1. #2 is the ominous statement: "we will make it up some other way".
You: That tells me more charges are coming down the pike to "make up for it", as BOA said in their own words.
You: You still haven't answered my question: is $70 fees excessive for $5 overdrawn?
Abegail : It can also mean that the bank will work on the cost side rather than the revenue side.
You: I take it your answer is "YES", or you would've answered it. I'll assume "YES".
Abegail : I said no earlier.
Abegail : If we are to manage our accounts then the fees will certainly not apply.
Abegail : And our overdraft policy is pretty much the same as other banks.
You: You DON'T think $70 is excessive for $5 overdrawn? LOL! You just proved why people hate BOA and they are losing customers. You think, what is it, 12x fine of the cost, what is that, 1,200% fine, is not excessive! LOL!!!!!!!!!
You: BOA tricks people by approving a $1 purchase so they get a $35 fine.
You: they'll approve someone buying a bottle of water for $1 without explicit consent of the customer
You: what customer would want to pay $36 for a bottle of water? Who are you kidding???
Abegail : The bank doesn't charge an overdraft fee for debit card purchases.
You: AND...BOA was caught and pleaded guilty to sorting transactions to INCREASE FINES.
You: BOA sorts transactions to INCREASE fines.
You: They'll put the largest transaction first, so the smaller ones bounce, creating more fines.
You: instead of paying all the smaller ones first.
You: Banks made BILLIONS off of fines, and had to change their ways. But they said they will "make up for the lost revenue". That doesn't sound good to me.
Abegail : I respect your opinion.
Abegail : Would there be anything else I can look up for you today, Dan?
You: http://www.youtube.com/watch?v=Db_P0wHsSz0
You: swat team in stl protects BOA, from customers closing their accounts
You: why BOA fired me:
You: http://www.youtube.com/watch?v=a5E0WNO7e_Q
You: you're defending a BAD company
You: no, I guess that's all, I'll be putting this whole thing up on my internet site, though
Abegail : Have a godo evening.

Isn't it incredible that these entities NEVER make any billing "mistake" to their financial detriment? This is systemic fraud - which is now legal in the Fascist States Of America - if you're a bank.
Who are the Conspirators To Commit Systemic Fraud? there are real people with real names in planning meetings dreaming these illegal schemes up. It's called Conspiracy To Commit Fraud.
The public-facing agents such as these chat room lackeys are simply doing what they were instructed to do by the co-conspirators. - plunger
